What Is It?

A Power of Attorney has been legally defined in Singapore as “an instrument created by a person who entrusts someone to act on his behalf.”

Essentially, it is a document that allows you to authorize and empower another person to act for you for certain matters under Singapore law. As such, a Housing Development Board (“HDB”) Power of Attorney allows you to authorize someone else to act on your behalf for certain matters relating to the HDB.

Why would I need a HDB Power of Attorney?

Regardless of whether you buy, sell or lease your HDB flat, there will be certain documents you will need to sign at different stages of the transaction (e.g. Option to Purchase, Mortgage Agreement, Lease Agreement, etc).

If you are somehow unable to tend to these matters (e.g. you have been posted overseas for work for an extended period of time), you may require a HDB Power of Attorney to ensure that your HDB transactions proceed smoothly.

When will you need a HDB Power of Attorney?

There are a number of situations in which you may require a HDB Power of Attorney, some examples of which include:

1) Buying or Selling a HDB flat

Generally, when either buying or selling a HDB flat, you will be required to sign certain documents and attend certain events. If you are unable to do so, you will need a HDB Power of Attorney.

2) Buying a Build-to-Order (“BTO”) flat

Similarly, if you are purchasing a BTO flat, you will be required to sign certain documents and attend certain events, such as the selection of flat, sales agreement and collection of keys.

If you are unable to do so, you will need a HDB Power of Attorney.

3) Sub-letting a HDB flat

Subletting a HDB flat also requires a HDB Power of Attorney in the event you’re unable to be around.
